These Terms of Service (“Terms”) govern your access to and use of the mobile application and related services operated by Blupalms LLC (“Blupalms,” “we,” “us,” or “our”), including any content, functionality, AI-powered features, and related services (collectively, the “App” or “Services”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use the App. By using the App, you represent and warrant that:
If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.
The App provides skincare-related tools, visual progress tracking, onboarding questionnaires, AI-generated insights, recommendations, and related features.
Some features may allow you to upload or capture images, including photos of your face, in order to generate insights, recommendations, or progress visualizations.
The App is provided for informational, educational, and personal use only.
The App and all information, content, outputs, recommendations, insights, visualizations, and other materials made available through the App are for informational purposes only and are not medical advice.
Blupalms is not a medical provider, dermatologist, or healthcare professional. The App does not diagnose, treat, cure, or prevent any disease or medical condition.
You should always seek the advice of a qualified physician or other licensed healthcare provider with any questions regarding a medical or skincare condition. Never disregard professional medical advice or delay seeking it because of something you read or receive through the App.
Your use of the App and any reliance on its content is solely at your own risk.

You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may upload, submit, or otherwise provide content through the App, including photos, text, profile information, progress images, and other materials (“User Content”).
You retain ownership of your User Content. However, by submitting User Content, you grant Blupalms a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, process, and use such User Content solely as necessary to operate, provide, maintain, and improve the App and its features.
You represent and warrant that:
We may remove or restrict access to User Content that we believe violates these Terms or may expose us or others to liability.
Certain features of the App may require you to upload or capture a photo of your face. By using those features, you expressly consent to the collection, processing, and storage of that image as described in our Privacy Policy.
You acknowledge and agree that:
If you do not consent to this processing, do not use features that require face images.
Some features of the App may be offered on a paid basis, including one-time purchases, subscriptions, premium features, or free trials that convert into paid plans.
If you purchase a subscription or other paid feature through Apple’s App Store, Google Play, or another platform, your purchase is governed by that platform’s billing terms in addition to these Terms.

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, retain, and disclose your information, including face data and AI-generated outputs.

We may also include links to third-party websites or services. We are not responsible for the content, policies, or practices of third parties. Your interactions with third-party services are governed by their own terms and policies.
The App, including its software, design, text, graphics, trademarks, logos, content, features, and functionality, is owned by Blupalms LLC or its licensors and is protected by applicable intellectual property laws.
Except for the limited right to use the App under these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the App unless we expressly authorize it in writing.
We retain personal information, face data, and related outputs as described in our Privacy Policy, including to provide App functionality such as user history and progress tracking.
You may request deletion of your data or account termination by contacting us. Upon account deletion or termination, we will delete or de-identify your information as required by applicable law and our retention practices, though some information may be retained for legal, security, fraud prevention, backup, or compliance purposes.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUPALMS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.
We do not guarantee that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUPALMS LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF:

You agree to defend, indemnify, and hold harmless Blupalms LLC and its officers, members, employees, affiliates, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
The App is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without verified parental consent. If we learn that we have collected such information, we will delete it promptly.
We may modify, suspend, or discontinue the App or any part of it at any time.
We may also update these Terms from time to time. If we make material changes, we may provide notice through the App, by email, or by other reasonable means. Your continued use of the App after updated Terms become effective constitutes your acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction and venue of those courts.
